This Patient Rights Notice (“Notice”) describes how Zaya Care–affiliated professional entities — Bienetre Medical PC (NY) and Bonheur Medical PC (NJ) — and the licensed health care professionals providing services through those entities (collectively, the “Practice”), may use and disclose your health information. The Practice operates in affiliation with its management services organization, Zaya Care, Inc., which acts as a HIPAA Business Associate to the Practice (collectively, “Zaya Care,” “we,” “us,” and “our”), and together they form an organized health care arrangement (“OHCA”) under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). Zaya Care, Inc. does not provide clinical services or make clinical decisions for the Practice or any of its affiliated health care professionals. As permitted by HIPAA, entities within the OHCA may share protected health information (“PHI”) with one another for purposes of treatment, payment, healthcare operations, and other uses and disclosures authorized or required by law. This Notice also outlines your rights with respect to your PHI and the Practice’s legal obligations to safeguard that information. It applies only to PHI governed by HIPAA and does not extend to information outside the scope of HIPAA regulation.
At Zaya Care, our goal is to make quality healthcare services accessible and respectful for every patient. Whether care is delivered in person or through telehealth, patients are entitled to the following rights:
Respect and Non-Discrimination
Patients have the right to be treated with dignity, respect, and consideration at all times.
Services will not be denied or limited because of age, race, color, national origin, religion, sex, sexual orientation, gender identity, disability, source of payment, or any other protected status under law.
Information and Participation
Patients have the right to clear and understandable information about their health, treatment options, and care plan.
Patients may ask questions and receive timely answers.
Patients have the right to participate in decisions about their care and to designate a representative to participate on their behalf if desired.
Consent and Refusal
Patients have the right to make informed decisions about their care, including the right to consent to or refuse treatment, as permitted by law.
Patients may change their mind about treatment at any time, consistent with medical standards and legal requirements.
Privacy and Confidentiality
Patients have the right to privacy during the course of their care.
Patient information and records will be kept confidential as required by federal and state law.
Zaya Care will only share information with others involved in a patient’s care or as otherwise legally permitted.
Access to Records
Patients have the right to review and request a copy of their medical records, subject to applicable laws and reasonable procedures for access.
Patients may request corrections to their records if they believe information is incomplete or inaccurate.
Safety and Care Standards
Patients have the right to safe, professional, and ethical healthcare services delivered by licensed providers.
Patients have the right to continuity and coordination of care, including appropriate referrals when needed.
Communication and Accessibility
Patients have the right to receive information in a manner that is accessible, including language assistance or auxiliary aids, as required by law.
Telehealth patients have the same rights to clarity, privacy, and quality as those receiving in-person services.
Billing Transparency
Patients have the right to receive a clear and itemized explanation of charges for services provided.
Patients will be informed of their financial responsibilities, including insurance coverage and out-of-pocket costs.
Complaints and Grievances
Patients have the right to voice complaints or concerns about their care without fear of retaliation.
